Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the website located at bluffcityperformance.com (the “Site”) and the services offered by Bluff City Performance (“we,” “us,” or “our”) at our facility in Collierville, Tennessee. By using the Site, booking a class, signing up for a membership, or entering our facility, you agree to be bound by these Terms. If you do not agree, please do not use our Site or services.

1. Services

Bluff City Performance is an Official HYROX Training Club offering HYROX-focused group training, open gym access, personal training, and related fitness services. Descriptions of classes, schedules, and amenities on the Site are subject to change without notice.

2. Memberships and Payments

  • Memberships are billed on a recurring basis unless otherwise stated at sign-up.
  • Current pricing is displayed on our Pricing page. Fees are subject to change with reasonable notice to active members.
  • Members are responsible for keeping payment information current. Failed payments may result in suspension of access until resolved.
  • Cancellations must follow the process described at sign-up or as communicated by our staff.

3. Class Booking and Cancellations

  • Classes may require advance booking through our scheduling system.
  • Please arrive on time. Late arrivals may be denied entry for safety and class flow.
  • If you cannot attend a booked class, please cancel as early as possible so another athlete can take your spot.
  • We reserve the right to cancel or reschedule classes due to low attendance, instructor availability, or facility needs.

4. Health, Safety, and Assumption of Risk

Participating in high-intensity fitness training involves inherent risks, including risk of injury. You acknowledge that you are voluntarily participating and assume all risks. You should consult a physician before beginning any exercise program. If you experience pain, dizziness, or shortness of breath, stop immediately and seek medical attention.

5. Facility Rules

  • Use equipment safely and re-rack weights after use.
  • Respect coaches, staff, and other members.
  • Do not use the facility while under the influence of drugs or alcohol.
  • We reserve the right to refuse service or revoke access for unsafe, disruptive, or disrespectful behavior.

6. Intellectual Property

All content on the Site, including text, images, videos, logos, and branding, is owned by or licensed to Bluff City Performance and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, Bluff City Performance and its owners, coaches, staff, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. Our total liability for any claim arising from these Terms or your use of our services shall not exceed the amount you paid us in the three months preceding the event giving rise to the claim.

8. Indemnification

You agree to indemnify and hold harmless Bluff City Performance and its owners, coaches, staff, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Site or services, your violation of these Terms, or your violation of any rights of another person or entity.

9. Termination

We may suspend or terminate your access to the Site or our facility at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to us, other members, or third parties.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Shelby County, Tennessee.

11. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be posted on this page with an updated effective date. Your continued use of the Site or services after any changes constitutes your acceptance of the revised Terms.
